Terms of Service

eCENTRIC-SPORTS provides independent sports news, commentary, analysis, statistics, rankings, opinions, entertainment, interactive features, and related programming. The Service may include team-focused pages and programming covering professional or collegiate teams, leagues, conferences, athletes, coaches, and media organizations.

Content may be created from or based upon publicly available information, press conferences, news reports, league and team announcements, statistics, podcasts, social media, third-party publications, user submissions, and other sources.

Sports news can change rapidly. Although we seek to provide useful and timely content, we do not guarantee that any information made available through the Service is complete, accurate, current, available, or error-free.

eCENTRIC-SPORTS uses artificial intelligence and related technologies in its programming and interactive services. Hosts, personalities, voices, likenesses, images, dialogue, responses, summaries, rankings, analysis, or other material may be artificially generated, digitally created, or produced with AI assistance.

Unless expressly identified otherwise, a virtual or AI-generated host is a fictional or digital character and is not a real human journalist, broadcaster, athlete, coach, expert, or other person. Any unintended resemblance to an actual person does not indicate identity, endorsement, or affiliation.

AI systems can produce incorrect, incomplete, outdated, misleading, biased, or unexpected information. Independently verify information important to a decision. AI-generated material is for informational and entertainment purposes and is not professional, legal, medical, financial, investment, or gambling advice.

If you submit a question or other material to an AI or interactive feature, it may be processed by automated systems and service providers, as described in our Privacy Policy. Your question and the resulting response may be displayed publicly, excerpted, edited, rebroadcast, or reused in eCENTRIC-SPORTS programming or elsewhere in the Service, subject to Section 10 and any notice presented when you submit it. Do not submit confidential, highly sensitive, or third-party personal information.

Submitting a question does not guarantee an answer or create a professional, fiduciary, advisory, or other special relationship.

The Service may report, discuss, analyze, compare, or display betting lines, point spreads, moneylines, totals, probabilities, predictions, sportsbook information, or other wagering-related information.

eCENTRIC-SPORTS is not a sportsbook, does not accept wagers, and does not place wagers for users. Odds and wagering information may originate with third parties and change at any time. We do not guarantee any odds, line, prediction, or wagering information.

Nothing on the Service guarantees an outcome or recommends that you place a wager. You are responsible for determining whether wagering is lawful where you are located and whether you meet all age and eligibility requirements. Any decision to wager is entirely at your own risk.

eCENTRIC-SPORTS is an independent sports news, commentary, analysis, and entertainment service.

Unless expressly stated otherwise, eCENTRIC-SPORTS is not affiliated with, sponsored by, approved by, authorized by, or endorsed by the National Football League, any NFL club, or any other professional or collegiate sports league, conference, team, club, athlete, coach, broadcaster, sportsbook, media company, podcast, publication, or organization discussed through the Service.

Team-focused page names, geographic references, team and league names, and other third-party references are used for news reporting, commentary, identification, informational, nominative, or other lawful purposes. Third-party trademarks, service marks, trade names, logos, publicity rights, and other intellectual property remain the property of their respective owners.

Some features require an account. You agree to provide accurate information, keep it reasonably current, safeguard your credentials, and promptly notify us at contact@eCentricSports.com if you suspect unauthorized access. You are responsible for activity conducted through your account to the extent permitted by law.

You may not sell or transfer an account, create an account for someone else without authorization, or create additional accounts to evade a restriction, suspension, vote limit, eligibility rule, or these Terms.

Display names and profiles may not impersonate another person or organization, falsely imply affiliation or endorsement, contain profanity or hate speech, infringe another party's rights, or mislead users. We may reject, change, reset, or require a change to a display name and may restrict an account when reasonably necessary.

You may initiate account deletion through Account Settings if available, or by contacting us. Deletion may not immediately remove material incorporated into public discussions, programming, rankings, certificates, security or legal records, or backups. See our Privacy Policy for further details.

The Service may offer a community program currently referred to as Club Insider, Insider Club, Team-Centric Insiders, or another announced name (the "Club Insider Program"). Each participating team-focused community may have its own Insider Club.

Eligible members may receive a sequentially numbered digital certificate or designation based generally upon the order in which qualifying signups are recorded. A number or certificate is commemorative and personal. It is not money, property, a security, an ownership interest, a transferable asset, an assurance of seniority, or a guarantee of continued status, benefits, access, or recognition. We may correct numbering errors and address duplicate, fraudulent, incomplete, or ineligible registrations.

Maintaining Club Insider status requires continued compliance with these Terms and separately published participation requirements, codes of conduct, election procedures, and eligibility standards (collectively, the "Club Rules"). Status may become inactive, be suspended, or be revoked if a member no longer meets those requirements. Club Rules may vary by club and may be updated as the program develops.

Participating Insider Clubs may hold annual elections for their own boards. A club board is expected to include at least a president and may also include a vice president, secretary, treasurer, or other positions described in the Club Rules. Club boards may help administer ordinary club activities and calendars only within authority expressly granted by eCENTRIC-SPORTS and the Club Rules.

Club Insider membership or office does not make a member an employee, partner, agent, franchisee, legal representative, owner, spokesperson, or fiduciary of eCENTRIC-SPORTS. A member or club board may not bind eCENTRIC-SPORTS, contract for it, incur obligations in its name, collect money on its behalf, use its intellectual property outside granted permissions, or claim authority to speak for it. Club elections and offices create no ownership or governance rights in eCENTRIC-SPORTS itself.

We may oversee activities, establish safeguards, resolve eligibility or election disputes, remove officers, suspend club activities, or modify or discontinue the program when reasonably necessary for legal compliance, safety, integrity, or operation. Club Rules may address officer duties, nominations, voting, terms, vacancies, finances, events, and calendars. If Club Rules conflict with these Terms, these Terms control unless expressly stated otherwise.

The Service may allow users to vote in polls, reorder or rank issues, and like or favorite athletes, podcasters, programs, episodes, or other subjects. These features reflect participation by some users at a particular time and are not scientific surveys, official results, or necessarily representative of all fans.

You may not manipulate results through multiple accounts, bots, scripts, coordinated inauthentic activity, vote trading, purchased engagement, false identities, technical circumvention, or any deceptive method. We may remove, recalculate, freeze, or reset activity reasonably believed invalid and restrict responsible accounts.

The Service may allow users to submit questions, comments, rankings, votes, profile information, feedback, suggestions, images, text, applications, Club Insider materials, or other content ("User Content"). You retain any ownership rights you have and remain responsible for your User Content.

You represent that you have the rights and permissions necessary to submit User Content and grant this license, and that your User Content and our permitted use will not violate law or another person's rights.

By submitting User Content, you grant eCENTRIC-SPORTS a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, process, adapt, format, translate, excerpt, edit, publish, display, perform, distribute, transmit, create technically necessary derivatives from, and otherwise use it to operate, provide, moderate, promote, and improve the Service and eCENTRIC-SPORTS programming.

This license includes displaying a Club Insider name, number, club designation, and information the member elects or is instructed to make public on a profile, listing, or shareable digital certificate; presenting user questions and related AI responses; and quoting or discussing submissions in programming or social media. Personal information will be handled under our Privacy Policy and any feature-specific notice.

Removing content or deleting an account does not require us to recall copies already published, distributed, incorporated into programming, retained by other users, or kept for legal, security, backup, or recordkeeping purposes. Submission does not guarantee publication, a response, Club Insider status, or compensation.

Users may report comments, display names, profiles, Club Insider activity, or other material through available tools or by contacting us. We may review reports but do not guarantee a particular result or response time.

We may refuse, hide, remove, restrict, preserve, or restore User Content; limit interactive privileges; invalidate engagement; rename an account; remove a club officer; or warn, suspend, or terminate a user when reasonably appropriate to enforce these Terms, Club Rules, or law, or to protect the Service or others.

We are not obligated to monitor all User Content and do not endorse it merely because it appears through the Service.

Except for User Content, third-party material, and content identified as belonging to others, the Service and its original materials are owned by or licensed to eCENTRIC-SPORTS and protected by law. They may include names, branding, graphics, layouts, programming formats, video, audio, scripts, articles, databases, software, virtual characters, AI-host designs, voices, animations, and character elements.

We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable right to access and use the Service for lawful, noncommercial personal use. Except as permitted by law or authorized by us in writing, you may not reproduce, distribute, sell, license, publicly display, commercially exploit, modify, republish, remove rights notices from, or create derivative works from our proprietary content.

You may not use bots, crawlers, scrapers, automated agents, data-mining tools, or similar technologies to systematically access, copy, collect, index, reproduce, or extract Service content or data except as authorized by us or permitted by law.

You may not use Service content to train, develop, fine-tune, evaluate, or improve an AI or machine-learning system without our written permission, except where the restriction is prohibited by law. Legitimate public indexing by generally recognized search engines is permitted unless our technical controls indicate otherwise.

The Service may reference, quote, embed, display, or link to third-party websites, videos, podcasts, social networks, statistics providers, broadcasters, sportsbooks, advertisers, news organizations, and services. They are controlled by their operators and may have separate terms and privacy policies.

A reference, link, ranking, or discussion does not necessarily constitute endorsement, sponsorship, affiliation, or recommendation. We are not responsible for third-party availability, accuracy, security, policies, products, services, or content.

If you believe material on the Service infringes your copyright, send a notice to contact@eCentricSports.com containing:

• Identification of the copyrighted work or a representative list.
• Identification of the allegedly infringing material and information sufficient to locate it.
• Your name, address, telephone number, and email address.
• A statement that you have a good-faith belief the disputed use is not authorized by the owner, its agent, or law.
• A statement under penalty of perjury that the notice is accurate and you are the owner or authorized to act for the owner.
• Your physical or electronic signature.

We may remove or restrict material in response to a valid notice and may terminate repeat infringers when appropriate. A person who knowingly materially misrepresents infringement may be liable under applicable law. If a separate designated DMCA agent or mailing address is later published, notices should be sent to that designated contact.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." eCENTRIC-SPORTS DISCLAIMS EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE EXTENT THEY MAY LAWFULLY BE DISCLAIMED.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT INFORMATION, PREDICTIONS, STATISTICS, ODDS, AI RESPONSES, VOTES, RANKINGS, CERTIFICATES, OR OTHER CONTENT WILL BE ACCURATE, COMPLETE, CURRENT, OR ACHIEVE ANY PARTICULAR RESULT.

Some jurisdictions do not permit certain exclusions, so some may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, eCENTRIC-SPORTS AND ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THE SERVICE.

This includes losses arising from reliance upon sports information, AI content, predictions, statistics, odds, third-party content, wagering information, user activity, Club Insider administration, elections, certificates, rankings, or the loss of content or access.

To the extent liability cannot lawfully be excluded, it is limited to the maximum extent permitted by law. Nothing excludes liability that cannot legally be excluded or limited.

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles, except where applicable law requires otherwise. The Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions in this Section.

Informal Resolution

Before beginning arbitration, you and eCENTRIC-SPORTS agree to make a good-faith effort to resolve any dispute, claim, or controversy arising out of or relating to the Service, these Terms, Club Rules, or your relationship with eCENTRIC-SPORTS (a "Dispute"). The party asserting a Dispute must first send written notice describing the nature and basis of the Dispute and the relief requested. Notice to eCENTRIC-SPORTS must be sent to contact@eCentricSports.com and any mailing address listed in Section 25. The parties will have thirty (30) days after receipt of the notice to attempt to resolve the Dispute informally before arbitration is commenced.

Mandatory Binding Arbitration

Except for the limited exceptions stated below, any Dispute that is not resolved through the informal-resolution process will be resolved exclusively through final and binding individual arbitration rather than in court. Arbitration will be administered by the American Arbitration Association ("AAA") under the AAA rules applicable to the Dispute, including the AAA Consumer Arbitration Rules when they apply, as modified by these Terms. The arbitration will be conducted by a single neutral arbitrator.

Unless applicable law or the applicable arbitration rules require otherwise, arbitration may be conducted by telephone, videoconference, written submissions, or at a reasonably convenient location. The arbitrator may award the same individual remedies that would be available in a court of competent jurisdiction, subject to these Terms and applicable law, and the arbitrator's award may be entered as a judgment in any court having jurisdiction.

Waiver of Jury Trial

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND eCENTRIC-SPORTS EACH WAIVE THE RIGHT TO HAVE A DISPUTE COVERED BY THIS ARBITRATION AGREEMENT DECIDED BY A JUDGE OR JURY IN COURT.

Individual Proceedings; Class and Representative Action Waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, ARBITRATION WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS. NEITHER YOU NOR eCENTRIC-SPORTS MAY BRING, JOIN, OR PARTICIPATE IN A DISPUTE IN ARBITRATION AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY AWARD RELIEF ONLY TO THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO RESOLVE THAT PARTY'S INDIVIDUAL CLAIM.

Exceptions to Arbitration

Either party may bring an individual claim in small claims court if the claim qualifies and remains solely within that court's jurisdiction. Either party may also seek temporary or preliminary injunctive relief from a court of competent jurisdiction when reasonably necessary to prevent actual or threatened infringement, misappropriation, or other violation of intellectual-property rights or to preserve the status quo pending arbitration. Any dispute that applicable law prohibits from being arbitrated may be brought in a court of competent jurisdiction.

One-Year Deadline to Bring Claims

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY DISPUTE, CLAIM, OR CAUSE OF ACTION ARISING OUT OF OR RELATING TO THE SERVICE, THESE TERMS, CLUB RULES, OR YOUR RELATIONSHIP WITH eCENTRIC-SPORTS MUST BE FORMALLY COMMENCED IN ARBITRATION OR, IF THE CLAIM IS NOT SUBJECT TO ARBITRATION, IN A COURT OF COMPETENT JURISDICTION WITHIN ONE (1) YEAR AFTER THE CLAIM OR CAUSE OF ACTION ACCRUES. IF IT IS NOT COMMENCED WITHIN THAT ONE-YEAR PERIOD, IT IS PERMANENTLY BARRED. THIS CONTRACTUAL LIMITATION PERIOD DOES NOT APPLY WHERE APPLICABLE LAW PROHIBITS SHORTENING THE OTHERWISE APPLICABLE LIMITATIONS PERIOD.

Arbitration Fees and Costs

Payment of arbitration filing, administration, and arbitrator fees will be governed by the applicable AAA rules and applicable law. eCENTRIC-SPORTS will pay arbitration fees that it is required to pay under applicable law or the applicable arbitration rules. Each party will otherwise be responsible for its own attorneys' fees and costs except where applicable law, the arbitration rules, or the arbitrator permits or requires an award of fees or costs.

Court Venue for Non-Arbitrable Disputes

Any Dispute that is not subject to arbitration and is not brought in small claims court will be brought exclusively in the state courts located in Sauk County, Wisconsin, or, if federal jurisdiction exists, the federal court with jurisdiction over Sauk County, unless applicable law gives you the right to bring the claim elsewhere. You and eCENTRIC-SPORTS consent to those courts' personal jurisdiction and venue.

Severability of Arbitration Provisions

If any portion of this arbitration agreement is determined to be invalid or unenforceable, that portion will be severed or limited to the minimum extent necessary and the remaining provisions will continue in effect, except where applicable law requires a different result or severance would materially alter the fundamental nature of the agreement to arbitrate. Nothing in this Section waives any right or remedy that cannot lawfully be waived.

If any provision is unlawful, invalid, or unenforceable, it will be enforced to the maximum extent permitted or severed, and the remaining provisions will remain effective.

Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.

These Terms, the Privacy Policy, Club Rules, and additional terms expressly applicable to particular features constitute the agreement between you and eCENTRIC-SPORTS concerning the Service. Section headings are for convenience only.
